Ok, the question, is sex with dead bodies, even if you are dead, still be ilegal?
That poses a interesting question.
If theoretically , the dead were able to have sex, be it by reanimation of dead tissue or perhaps on a spiritual level as was touched upon in the linked topic then I dare say i would not indeed be illegal unless the corpse was not of consenting age or in agreeance to the partaking of sexual gratification.
After all, the only reasons that postmortem copulation is illegal is partly due to the moral standpoint of necrophilia being not normal and therefore not an agreed upon societal behavior and secondly due to the biblical laws stating that one shalt not desecrate the dead...and lets face it...pumping a corpse full of sticky spooge juice would more than likely be classified as desecration.
Whether these ideals would carry onto the afterlife could be debated as many different faiths ave many different afterlives.
Also of note wold be the fact that consenting age at time of death would have little bearing on the willingness of spirits to engage in sexual acts as the mental age of the spirit in question may in fact be much more mature taking into account time of death and time spent dead, which in turn could make the spirit much older than his or her sexal partner.
I do hope this answers some of your questions form my point of perspective.

They wouldn’t be convicted for necrophilia as it is by definition a sexual fetish between a living and a dead being.
If both parties are dead, it can’t be necrophilia.
If one of the corpses was under legal age, then a statutory rape charge may be able to be pressed, however I don’t think that our modern laws factor in those beings that are already dead.
